Terms and Conditions
Article 1. Applicability
1.1 These General Terms and Conditions apply to all offers, orders and agreements of our webshop www.3-mmc-shop.nl Netherlands.
1.2 Accepting an offer or placing an order implies that you accept the applicability of these terms and conditions.
1.3 The provisions of these Terms and Conditions can only be deviated from in writing, in which case the other provisions will remain in full force and effect.
1.4 All rights and claims, as stipulated in these terms and conditions and in any further agreements for the benefit of our webshop, are also stipulated for intermediaries and other third parties engaged by our webshop.
Article 2. Offers/agreements
2.1 All offers from our webshop are without obligation and our webshop expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations. See also article 3.6.
2.2 An agreement is only concluded after acceptance of your order by our webshop. Our webshop is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, our webshop will inform you within ten (10) working days after receipt of the order.
Article 3. Prices and payments
3.1 The prices stated for the products and services offered are in Euros, including VAT. and exclusive of handling and shipping costs, any taxes or other levies, unless otherwise stated or agreed in writing.
3.2 Payment must be made without discount or compensation the same day as the invoice date if it concerns deliveries within the Netherlands, we only deliver within the Netherlands.
3.3 Payment can be made in (one of) the manner(s) as indicated during the ordering process.
3.4 If the prices for the offered products and services increase in the period between the order and its execution, you are entitled to cancel the order, but after payment the order is binding.
Article 4. Delivery
4.1 The delivery times specified by our web shop are only indicative. Exceeding any delivery term does not entitle you to compensation or the right to cancel your order or to dissolve the agreement, unless the exceeding of the delivery term is such that you cannot reasonably be expected to maintain the agreement. In that case you are entitled to cancel the order or to dissolve the agreement insofar as this is necessary.
4.2 The delivery of the products will take place at the place and time at which the products are ready for dispatch to you.
Article 5. Retention of title
5.1 The ownership of the delivered products is only transferred if you have paid all that you owe our web shop under any agreement. The risk with regard to the products already transfers to you at the time of delivery.
Article 6. Intellectual and industrial property rights
6.1 You must fully and unconditionally respect all intellectual industrial and property rights that rest on the products delivered by our webshop.
6.2 Our webshop does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.
Article 7. Complaints and liability
7.1 You have the obligation to examine whether the products comply with the agreement upon delivery. If this is not the case, you must inform our web store of this as soon as possible and in any case within seven (7) working days after delivery, at least after observation was reasonably possible, in writing/email and with reasons.
7.2 If it is demonstrated that the products do not comply with the agreement, our web shop has the choice to replace the relevant products with new products against their return or to refund the invoice value thereof.
7.3 If you do not wish to purchase a product for whatever reason, you as a private individual have the right to return the product to our webshop within seven (7) working days after delivery. Return shipments are only accepted in this case if the packaging of the product is undamaged, whereby the costs for return shipments are also for your account.
Article 8. Orders/communication
8.1 For misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of the internet or any other means of communication in the traffic between you and our webshop, or between our webshop and third parties, insofar as this relates to the relationship between you and our webshop, our webshop is not liable, unless and insofar as there is intent or gross negligence on the part of our webshop.
Article 9. Force majeure
9.1 Without prejudice to its other rights, in the event of force majeure, our web shop has the right, at its own discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention, such by notifying you in writing. without our web shop being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
9.2 Force majeure is understood to mean any shortcoming that cannot be attributed to our web shop, because it is not due to its fault and is not for its account under the law, legal act or generally accepted standards.
Article 10. Miscellaneous
10.1 If you provide our webshop with an address in writing, our webshop is entitled to send all orders to that address, unless you inform our webshop in writing of another address to which your orders should be sent.
10.2 If our web shop allows deviations from these Terms and Conditions, whether tacitly or not, for a short or longer period of time, this does not affect its right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any right based on the fact that our web shop applies these Terms flexibly.
10.3 If one or more of the provisions of these Terms and Conditions or any other agreement with our webshop should conflict with any applicable legal provision, the relevant provision will lapse and it will be replaced by a new legally permissible one to be determined by our webshop. comparable provision.
10.4 Our web shop is authorized to use third parties for the execution of your order(s).
Article 11. Applicable law and competent court
11.1 All rights, obligations, offers, orders and agreements to which these terms and conditions apply, as well as these terms and conditions, are exclusively governed by Dutch law.
11.2 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands. The products are sent via PostNL. We will not be responsible for any delay or non-arrival or damage to the delivery. This is with PostNL or with the customer. We will not re-ship with letter post in the event of loss by postNL. We can only resend if it is proven that the package has not arrived at the address indicated by the customer. This only applies to packages that can be traced by means of a tracking code. We are not liable for filling in the address. The customer fills in an address and we ship there. If the address is wrong or something is missing, we can never be blamed for this and that is the customer's problem.
12. By placing an order in our webshop you agree to the rules and conditions below.
12.1 For all products you must be 18 years or older, by including these products in your order you confirm that you have already reached the minimum age of 18 years. In case of doubt, a copy of your proof of identity may be requested.
12.2 The purchase of products through this website is entirely at your own risk. We cannot be held responsible for damage resulting from the use of the delivered products.
12.3 You have carefully read and understood the product information page. Follow all product directions on our website and heed all warnings.
12.4 You are personally responsible for the care of ordered products. Keep them in a safe place, out of the reach of children, pets and people with impaired judgment, unless the product is intended for the above-mentioned target groups.
12.5 All our products are definitely not for human consumption and should at all times be kept out of the reach of children and animals and people who are less responsible.
12.6 All our products are sold for RESEARCH PURPOSES ONLY. We are therefore not liable for use for purposes other than the aforementioned.
12.7 Everyone who buys in our webshop must be 18 years or older. In case of doubt, we can cancel an order or ask for ID information.
12.8 We are never liable for consequences arising from use other than that mentioned above. When conducting research, we therefore assume that you have sufficient knowledge to do this.
